This document is an official offer (public offer) of RealityScan LLC to conclude a contract for the sale of digital goods on the terms set out below (Articles 435 and 437 of the Civil Code of the Russian Federation).
1. Terms and Definitions
- Seller — RealityScan LLC (ООО «РЕАЛИТИСКАН», TIN 3906394695, PSRN 1203900011677, registered address: 2 Ozernaya St., apt. 74, Kaliningrad, Kaliningrad Region, 236029, Russia, email: info@realityscan.ru).
- Website — the digital goods online store available at https://realityscan.ru, including its subdomains and mobile version.
- Buyer — a legally capable individual, sole proprietor, or legal entity that places an Order under the terms of this Offer.
- Digital Goods — results of intellectual activity delivered in electronic form: 3D models, point clouds, LiDAR scanning data, orthophoto maps, digital elevation and terrain models, textures, drawings, object inspection reports, and other digital materials presented on the Website.
- Order — the Buyer's intention, submitted through the Website, to purchase the selected Digital Goods.
- Acceptance — full and unconditional acceptance of the terms of this Offer by paying for the Order.
- Account — the Buyer's personal section on the Website, accessible after registration.
2. General Provisions
2.1. By paying for an Order, the Buyer confirms having read the terms of this Offer and the Privacy Policy and accepts them in full and without reservations.
2.2. The contract is considered concluded when the Seller receives payment for the Order.
2.3. By accepting this Offer, the Buyer confirms being an adult with full legal capacity.
2.4. The relations between the parties are governed by the Civil Code of the Russian Federation, the Law of the Russian Federation "On Protection of Consumer Rights", and other applicable regulations.
3. Subject of the Contract
3.1. The Seller undertakes to deliver the Digital Goods to the Buyer (provide access to download them), and the Buyer undertakes to accept and pay for them under the terms of this Offer.
3.2. The name, contents, file formats, description, and price of the Digital Goods are specified on the corresponding product page on the Website.
4. Registration and Account
4.1. To place an Order, the Buyer registers on the Website, providing accurate information, including a valid email address.
4.2. The Buyer is responsible for keeping their credentials secure and for all actions performed using their account.
4.3. The Buyer independently ensures the availability of software and equipment required to receive and use the Digital Goods.
5. Prices and Ordering
5.1. Prices for Digital Goods are listed on the Website in Russian rubles (or in the display currency selected on the Website).
5.2. The Seller may change prices unilaterally; the price of a paid Order is not subject to change.
5.3. Discounts and promotions apply under the conditions specified on the Website at the time the Order is placed.
6. Payment
6.1. Payment is made using the methods available on the Website at checkout (bank cards, electronic payment services, account balance, and other listed methods).
6.2. Payments are processed by payment infrastructure operators; the Seller does not store the full details of the Buyer's bank cards.
6.3. A fiscal receipt is sent to the Buyer in electronic form in accordance with Federal Law No. 54-FZ.
7. Delivery of Digital Goods
7.1. Access to download the Digital Goods is provided to the Buyer after payment confirmation — in the "Downloads" section of the Account and/or via a link sent to the Buyer's email address.
7.2. The Seller's delivery obligation is considered fulfilled once the Buyer is technically able to download the goods.
7.3. In case of technical issues with access to paid goods, the Buyer contacts support at support@realityscan.ru. The Seller restores access within a reasonable time.
8. License and Intellectual Property
8.1. Exclusive rights to the Digital Goods belong to the Seller or other rights holders who placed the goods on the Website.
8.2. The Buyer is granted a simple (non-exclusive) license to use the Digital Goods for their own needs, including in the Buyer's commercial projects, unless otherwise specified on the product page.
8.3. Reselling, distributing, publishing in open access, or transferring the Digital Goods to third parties in their original form, as well as presenting them as one's own work, is prohibited.
9. Refunds
9.1. Digital Goods of proper quality are not subject to exchange or refund once the Buyer has been granted download access, since the goods are delivered electronically and cannot be returned.
9.2. If goods of improper quality are delivered (corrupted files, non-conformity with the description on the Website), the Buyer may request a replacement or a refund. Requests are sent to support@realityscan.ru with the Order number and a description of the problem.
9.3. The Seller reviews the request within 10 (ten) business days. Refunds are issued using the same payment method used for the purchase, unless otherwise agreed by the parties.
10. Liability
10.1. The Seller is not liable for the inability to use the Digital Goods for reasons attributable to the Buyer (software incompatibility, lack of required technical means or skills).
10.2. The parties are released from liability for non-performance of obligations caused by force majeure.
10.3. The Seller's aggregate liability under the contract is limited to the amount of the paid Order.
11. Personal Data
11.1. The Buyer's personal data is processed in accordance with Federal Law No. 152-FZ "On Personal Data" and the Privacy Policy published on the Website.
12. Final Provisions
12.1. The Seller may amend the terms of this Offer unilaterally. The new version takes effect upon publication on the Website and applies to Orders placed after its publication.
12.2. All disputes are resolved through negotiations; the pre-trial claim procedure is mandatory. Claims sent to info@realityscan.ru are answered within 10 (ten) business days of receipt.
12.3. If no agreement is reached, the dispute is referred to a court in accordance with the legislation of the Russian Federation.
